Northwest Art and Collectibles Terms of Sale
1) All items sold by Northwest Art and Collectibles to the best of our knowledge were obtained within lawful parameters. 2) We evaluate each item carefully and implicitly guarantee that the items are as described. 3) If the item is modern flintknapping art or has been modified post European contact, we will clearly state so, otherwise we implicitly guarantee the item to be ancient authentic. 4) We offer a conditional return privilege subject to the following conditions:
5) Return items that Northwest Art and Collectibles consigned to a 3rd party business, are subject to the terms of that business and the buyer. In other words, if you purchase an item that I consigned to another dealer, and you don't like it because it doesn't match the color of your shag rug, then you need to contact the person you bought the item from.
6) Speaking of privacy, if you decide to disparage Northwest Art and Collectibles or Myself in a public forum with the thought of leveraging a return, well then you just finalized the sale.
7) If you decide to send me an artifact back to me after the 30-day conditional return period because your finances fell on hard times or you decided to collect Beanie Babies instead, I will return the unsolicited package COD to you.
8) If you decide to leverage a post 30-day return by harassing phone calls in a manner that resembles how some unscrupulous collection agencies or telemarketers operate, I will not be agreeing to any return. 1 or 2 phone calls or emails is sufficient notification and I will respond to you within a reasonable time frame of 1-2 days.
9) A 14-day grace holding period will occur upon request to purchase an item. If beyond the 14-days no payment is received, then hold will be removed from the item and it will return as available to be purchased on the open market.
10) Layaways terms available up to a 90-day holding period provided that at least a 25% down payment is received within the 14-day grace period and payment is full by the end of the 90th day. At the end of the 90-day holding period if the layaway is not paid in full, then a 5% restocking fee will be assessed and the balance previously paid will be refunded. Any price discounts that were negotiated prior to discussing layaway terms are null and void once the buyer decides to purchase an item through layaway. In unique circumstances involving large purchases between myself and a long time friend, I will allow for accommodations, however receiving a regular payment each month and meeting the payment plan goes a long way of establishing trust and credibility. 11) I accept items that fall within the bounds of the 30-day conditional return period and will provide either a refund or a business credit towards the purchase of a different item. 12) If you see an item marked as sold or it disappears from online inventory at Northwest Art and Collectibles, then it is likely sold or no longer available. Please show some civil respect and save us both some time by refraining from contacting me with requests asking about who purchased the item and for how much. 13) Purchase approaches that involve denigrating the inventory item as a means to 'brow beat down the price' will be met with resistance and repeated abuse involving this purchase tactic will result in loss of purchase privileges with Northwest Art and Collectibles. There are better ways of negotiating a lower price that do not involve slamming the attributes of the item. 14) I accept payment via personal check, money order, cash (at your own risk), or PayPal. By July 2010 I should be set up with a merchant account and will be able to receive credit card payments direct. Also am willing to barter for professional services such as legal advice, medical, dental work, accounting, automotive parts, hand made woodworking, etc... so long as this bartering is ethical and legal. Plus am willing to consider inventory trades on select items provided that the deal is mutually beneficial to both businesses. 15) Certain books I will offer a 50% price discount to any college or university student provided that you provide me credible proof of your enrollment and you are the person you claim to be. If you are a student, agency or institution with full Native American or First Nations status and can provide me with proper credentials, I will offer you certain designed books FREE of charge provided that you pay me in advance to cover shipping cost to your destination. 16) I reserve the right to refuse sale to anyone for any good moral reason. That said, certain individuals have given me the run around in different ways in the past, so I will not bother dealing with that sort of nonsense with them again, hence the foundation of this sales term. 17) Items will not be shipped prior to receiving and clearing payment with my bank. 18) Items will be shipped within 3 business days of receiving and clearing payment with my bank. 19) Standard shipping expense costs are paid by Northwest Art and Collectibles include shipping through the US Postal System using Priority or Registered Mail with standard Delivery Confirmation, Signature Confirmation and Postal Insurance. I normally securely bubble wrap the items, pack with foam peanuts and sometimes stiffen the parcel with extra card board. Expedited shipping through Express Mail will be paid for in full by the buyer. We do not offer shipping service through Fed Ex or UPS. 20) State, Local and County Taxes at a combined total rate equal to 8.25% of the final sales price is charged on all items shipped within the State of Texas in compliance with State Tax Laws. 21) I do not add a 3% PayPal usage surcharge like other dealers do. 22) I do not provide client information to third parties. 23) If you are a member of the Genuine Indian Relic Society, Loveland Archaeological Society, or the Center for the Study of First Americans and can provide me with proof of this membership, then I will offer you a special 5% discount, provided that you inform me up front that you are claiming a discount prior to finalizing a sales price. 24) If you are a curator at a federal or state museum or exhibit and are seeking to procure a particular item from Northwest Art and Collectibles Inventory and can provide me with a donation tax receipt that the IRS will accept along with appropriate legal documentation, then I am willing to consider endowing your museum or exhibit with an inventory donation. 25) I will not honor any request to point on a map where I believe an artifact was found. Reason being is obvious, I did not find the artifact, nor was there when it was found, so it is impossible to know for certainty exactly where an item was collected. Plus, such a map could lead to opening a legal Pandora's box, something which I along with any reasonable person wish to avoid. 26) Only the facts as I understand them will be included in the Certificate of Evaluation and Provenance. |
